Why PSPO’s prohibiting pedlars are unlawful

Birmingham City Council and Bristol City Council are seeking to prohibit pedlary using the device of PSPO’s (Public Spaces Protection Orders).

In Birmingham a blanket prohibition is proposed and in Bristol an event prohibition is proposed.

Birmingham PSPO consultation ends April 30.

Bristol PSPO consultation ends April 20.

Administrators at pedlars.info have drafted a Formal Complaint against each PSPO and urge all pedlars and regulators including local authorities and police to be aware of this attempt to circumvent the Pedlars Act. This follows in 2024 a pedlar’s defeat of Birmingham City Council’s continued prosecution for acting as a pedlar. The case of Logie v Birmingham City Council established that the council’s interpretation and application of the Local Government (Miscellaneous Provisions) Act Schedule 4 Street Trading was wrong in law.
