Hi,
I have recently bought an electric icecream bike with my partner. We intend to sell soft scoop sourced from a reputable company in Bristol. Can you confirm that we would be ok to trade with a pedlars licence on the streets near parks and busy high streets (not in the centre)? Do we need to be moving or can we choose a spot and stay there for a few hours with the licence?
I would really appreciate any advice you have.

You need to study the meaning of Section 23 of the Pedlars Act and be aware that it is a pedlars choice to carry a certificate or not.

Bristol Council have adopted the LG(MP)A Schedule 4 and try to force this onto pedlary but para (2) states… The following are not street trading (a) trading by a person acting as a pedlar…full stop.
Our question to you is… Why not in the centre where all the customers need ice-cream?
Pedlars “go from town to town or to other men’s houses” meaning they are ambulant traders (with certificate)… unlike static traders (with licence)… a pedlar can and does move and easily moves if asked to do so… case law refers to 15-20 minutes but so long as you have customers then that time limit extends… you cannot be expected to move away from your customers.
