Logie-v-Birmingham City Council – Another Win for Pedlars
Birmingham City Council sought another prosecution against pedlar Andrew Logie in Birmingham Magistrates Court on 30 September 2024 and he contacted pedlars.info for assistance in providing an Application for Adjournment of Proceedings and a Request for Disclosure of Evidence.
The following day Birmingham City Council’s senior solicitor Jane Lineker emailed the Magistrates Court:
“The above case is listed for trial on 30th September 2024. In view of a recent High Court judgement, we are discontinuing proceedings against Mr Logie and we formally offer no evidence against him. On that basis, I would be grateful if the trial could please be vacated. I would be grateful if you could confirm that this matter can be dealt with in both parties’ absence? I will write to Mr Logie confirming that we are no longer proceeding with the Prosecution”.
This is a second win against wrongful interpretation and application of the Pedlars Act under the LGMPA Schedule 4 Street Trading. It indicates that Birmingham City Council has been wrongly prosecuting pedlars for many years and is why all pedlars should challenge each and every prosecution in LGMPA jurisdictions throughout the UK.
