Pedlars Alert: Support the Test Case to Protect Your Right to Trade
Andrew Logie, a certificated pedlar, stood up against Birmingham City Council in a true David vs Goliath legal battle — and won.
In Logie v Birmingham City Council [2024], the High Court ruled in Andrew’s favour, clarifying how pedlars may lawfully operate, including the right to remain stationary for trading purposes for up to 30 minutes before moving.
That precedent protects all law-abiding pedlars today.
But the fight isn’t over.
Local authorities across the UK — including Birmingham — are now trying to sidestep the High Court’s ruling by introducing local Public Spaces Protection Orders (PSPOs) that unlawfully prohibit all pedlary, full stop.
On 22 July 2025, Birmingham approved a PSPO banning pedlary in the city centre — even for certificated pedlars acting lawfully under the Pedlars Acts 1871 and 1881.
This is a direct attack on the rights affirmed in Andrew’s case.
This is now a national test case.
