Certificated pedlars have a national right under the Pedlars Acts 1871 and 1881 to trade “in any place throughout the United Kingdom.”
Public Spaces Protection Orders (PSPOs) — even under the new Criminal Justice Bill — cannot lawfully ban pedlary without clear authority from Parliament.
Any attempt to criminalise lawful pedlars is ultra vires (beyond powers), breaches the Principle of Legality, and violates human rights protections.
